NEW DELHI: Star Den Media Services has moved the Telecom Disputes Settlement and Appellate Tribunal (Tdsat) against Dish TV asking the DTH operator to pay for its channels as per the rates stipulated in the reference-interconnect-offer (RIO) by the Telecom Regulatory Authority of India.


According to Star Den counsel, Dish TV had refused to sign a fresh agreement after the earlier one expired on 2 August 2008. The DTH operator had a deal to carry Star Plus, Star One, Star Utsav, Star World, Star Gold, Star Movies, Star News, National Geographic Channel, The History Channel, Hungama, Disney Channel, Toon Disney Channel, Channel [V] and Star Vijay.

“Since Dish TV is continuing to avail signals of the channels even after the expiry of the agreement, it is liable to pay for the channels as per the rates stipulated in the RIO which is the requirement under the regulations. Disputes have arisen between the parties, inter-alia on account of the failure and refusal of Dish TV to enter into an interconnection agreement on the basis of RIO for all its channels,” Star Den submitted in its petition.

Star Den further alleged that Dish TV has been receiving signals of five additional channels - Times Now, Zoom, CNBC TV18, CNN IBN and CNBC Awaaz channels. Though these five channels were not part of the earlier agreement with Star India, Dish TV has failed to pay subscription charges for them also.

The case has been listed for hearing on 1 October, 2008.
