Tata Sky ‘Recharge & Win’ promotion
Terms and Conditions
Tata Sky subscribers participating in the Promotion shall be bound by the following terms and conditions:
Definitions
1. “Active account status” means a positive account balance in your Subscriber Account.
2. “Promotion Period ” means the period of the Promotion from 00:00 hrs on 7 June 2009 till 23:59 hrs on 6 August 2009
3. “Valid entry” means a Tata Sky account recharge done by You worth Rs 500 or more in a single transaction during the Promotion Period on the Tata Sky Helpline (IVR) using your credit card or the Atom mobile application .
Terms used herein but not defined shall have the same meaning as assigned to them in the Subscription Contract signed between You and Tata Sky.
Eligibility
1. The Promotion is open ONLY to Tata Sky subscribers with an Active account status both at the time of participation and prize selection.
2. The following persons cannot participate in this Promotion:
1. Employees and relatives of :
1. Tata Sky &
2. ATOM Technologies Ltd and its affiliates
3. Tata Sky business associates including its dealers and advertising agencies and
2. Anyone else who may be involved with the Promotion.
3. Tata Sky reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate. Only a Valid entry will be eligible for the prize selection process.
4. You must (i) be a resident of India (ii) be above 18 years of age and (iii) have a valid PAN card to participate in the promotion.
Selection of the Winning Tata Sky subscriber
1. To participate in the Promotion, you must send in a Valid entry.
2. The winner shall be selected from amongst the pool of participants via a random computer generated process under the supervision of a special panel.
3. The results generated will be final and binding.
Prize
1. During the Promotion Period, the daily prize is a DVD player and the monthly prize is an LCD TV.
2. The prize is not exchangeable for cash or any other offer.
3. The winner shall be contacted via phone at the phone number mentioned in the Subscription Contract.
4. Tata Sky may also send a letter to the winner at the address mentioned in the Subscription Contract requesting for a list of documents to be presented by the winner to claim the prize. Non-submission of necessary documents shall lead to disqualification of the winner and an alternative winner shall be chosen thereafter.
5. If Tata Sky is not able to contact the winner at the phone number or the address as per Tata Sky records by midnight seven days after Tata Sky 's first attempted notification, Tata Sky reserves the right to select an alternative winner and the original winner's entitlement to the prize will lapse.
6. Tata Sky will send the prize to the winner within one month of declaring the winner; The prizes shall be delivered to the winner at the Subscriber Address entered in the Tata Sky records. Tata Sky shall not be liable for delayed delivery or any damage caused to the prize during delivery. In the event of damage caused to the prize during delivery, winner(s) must take up this matter directly with the manufacturer / dealer. Tata Sky shall not be liable for any defect or deficiency in the prize. You acknowledge that the prizes are provided on an “as is basis” and You agree to contact the manufacturer / dealer directly for any quality, repair or warranty related issues.
General
1. Any participant who manipulates the Promotion in any manner whatsoever shall be liable for disqualification at the sole discretion of Tata Sky. In such event Tata Sky shall not be liable to consider even a Valid entry of the subscriber thereafter.
2. The payment of the prize shall be subject to deduction of applicable withholding taxes as per Indian Income Tax Laws
3. The winners will be responsible for any other relevant taxes arising from the receipt of the prize. You agree to indemnify Tata Sky against any claims incurred by Tata Sky on account of failure on your part to discharge your tax liabilities on the prize.
4. Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part this Contest or to withdraw it completely.
5. Tata Sky will have the right to use the image of the winners in any promotional material. By participating in the Promotion, You agree that in the event you are selected as the winner, You shall participate in any promotional activity(ies) and/or have Your name and likeness featured in any promotional material as Tata Sky may require.
6. Tata Sky will not be liable for any loss, damage or cancellation of this Promotion caused by events beyond its reasonable control including war, natural calamities, floods, failure of telecommunication network, etc.
7. You consent to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Promotion including but not limited to any misuse of the prize by the winner.
8. You acknowledge and agree that all disputes in relation to the Promotion shall be subject to Delhi jurisdiction.
9. Tata Sky is not responsible for printing or typographical errors in any Promotion related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error.
10. The Promotion is void where prohibited or restricted by law, and is subject to all applicable mandatory national, state and local laws.
