Aaj Ki Taja Khaber: MRTPC favours Dish TV over Tata Sky :evil:

The Monopolies and Restrictive Trade Practices Commission (MRTPC) has passed orders in favour of Dish TV on two applications, filed by a consumer organisation Sajag Upbhoghta and rival DTH operator Tata Sky.

Both complaints had alleged that the set top box free advertisement campaign of Dish TV in the print and electronic media was misleading.

The MRTPC passed an order favouring Dish TV as far as its print ads were concerned. It said, “As far as the advertisement in the print media is concerned which carries Dish TV’s advertisement, Aaj Ki Taja Khaber that offers free set top boxes; on a close scrutiny of these advertisements we notice that all such advertisements carry the payment scheme of Rs 3990 in a box.\"

\"It was obvious that prospective consumer who reads the details of the advertisement will be aware of the payment plan of Rs 3990 printed in the box alongside the advertisement and will reasonably conclude that the set top box is offered free of cost with this scheme. Therefore we do not find any misrepresentative being made to the prospective consumers in regard to the scheme.” MRTPC said.

The MRTPC, however, directed Dish TV to make sure it took some precautions as far as its electronic media campaign is concerned. The commission ordered it to “not carry any advertisement for its Set Top Box Free offer without indicating the Scheme of Rs 3990.”

The MRTPC accepted that Tata Sky being a competitor had no locus standi to file a complaint against Tata Sky under section 36A. It also decided that Dish TV's plea that \"Sajag Upbhoghta\" and the consumer Hari Shankar are put up by Tata Sky be investigated / examined as part of the ongoing trial.

Tata Sky in its arguments had alleged that set top boxes are not provided free by Dish TV. While Dish TV had argued that its Rs 3990 scheme has the facility of free set top box and it has been clearly indicated in the advertisements in the print media.
