Following is the mail I sent to Airtel Nodal Officer & Appellate Authority:
Hi,
This is to lodge a complaint against Airtel's recently introduced Fair Usage Policy (FUP).
I am a customer of Airtel's 256kbps Unlimited plan and since last week my connection speed has been forcibly reduced to 128kbps, without even informing me. On calling the Customer Care (CC) and pestering for a reason I was told that it's due to the FUP. When I wanted to lodge a complaint about this CC refused to take any.
As a customer I want Airtel to answer the following:
[*]When I had applied for the connection and signed in the User Agreement, it promised me two services - 256kbps & Unlimited. Now I am not getting one of these two promised services. As I did not sign any FUP agreement with Airtel and the consumer-service provider agreement on which I had signed did not have any such clause, so who gave Airtel the right to reduce my speed?
[*]Every month Airtel never falters in sending the bill and continues to send numerous reminders over mail & phone for payment of the bill. How come then with respect to FUP there has been no communication from Airtel?
[*]As a 256kbps unlimited plan customer, simple mathematics tells me, that I am entitled to approx 165GB of data transfer per month at the aforementioned speed. The 15GB limit introduced translates to hardly 10% of 165GB. So why is this policy being termed as a "fair usage" policy? Should I then conclude that this is a planned approach on part of Airtel to mislead consumers?
[*]My speed has been reduced from about the middle of my monthly billing cycle. Right now all I am getting is 128kbps speed, though I am paying the rental for 2556kbps for the entire month. Why should I continue to pay for a service I am not being rendered?
[*]After the forced reduction, my current speed is now 128kbps. Any connection speed below 256kbps cannot be termed as broadband according to TRAI guidelines. On what basis has Airtel decided to violate & ignore these guidelines?
[/list]Unless I am promptly provided with satisfactory answers for each of the questions above, I would have to lodge formal complaints against Airtel Broadband's FUP with TRAI, DOT & Consumer Court.
