bsnl broadband: A hacker has abused... Pl help?

A hacker hacked my computer through internet and abused by creating a text file named ''This computer has been hacked... sexy pics'' in my album folder.How can i trace his ip or complain about him?Is this a crime under IT act 08?How he can be punished if caught?
 
it would take too much effort and a lot of luck to 'catch' him. police is unlikely to be of any help to you unless you are some kind of a VIP. i suggest improving the security of your machine to prevent repetition of such incidents.
 
Can you be sure it was a "hacker" and not someone who had physical access to your PC behind your back? Anyway, back up data files only (no .exes, just .txt, .doc. .mp3 etc), reformat and reinstall the software first of all. If it is truly a hacker he would also have installed other software which will allow him in easily. And this time configure your software properly (and do not install freeware and other useless programs) so that you do not get hacked. Keep the OS and all software updated.
 
@liberty creating a *.txt file in your My Pictures Album folder, is done easily by accessing your computer in your own Home, Some one who has seen the "pictures" in your Album must have made the text file! You can also use Password protect to deny access to your "sensitive'" folders. What is the time and date the text file was made ? Were you Online at that time ?2.Your claim about "hacking" through Internet connection is far fetched. if you are the only one to access your computer , no other users are allowed, change your administrator PW, and don't keep computer On during your absence. and go to standby mode. Worst case : , your modem/router settings can be accessed, and even this can be avoided by changing Modem access USERID & Password often.Feedback.
 
It is a crime but forger about him getting punished....Just Install and run Malwarebytes Anti Malware...do a ful system scan...Use anti-virus soft. like Nod32 or Kaspersky...or AvastThats all you can do....
 
You can give a register a complaint with the cyber cell. To avoid this in future,1. Use a good firewall like Zonealarm or Comodo.2. Secure your wifi using encryption.3. Request your exchange for port forwarding.
 
If you are using Broadband connection then change your modem username password by default which is admin admin. There are utilities like Angry IP Scan which can scan the range of IP addresses which have their port 8080 open. You can easily type the desired IP address in the browser and it will open the modem configuration page on your browser. This technique was previously used for knowing someone else user name password. I think a little tweaking in this technique can able you to access other computer.
1. Change your modem password by opening page on 192.168.1.1
2. Use a good firewall software.
3. Turn off sharing of shared documents and drives.
 
The text file was created on 15 June 10 evening 6.30 as per the properties of the .txt file & i was online at that time.
I am not connected to any LAN or wifi
