Do toll roads violate article 19d:free movement

so there is no mention about milking money is legit.the world bank funded that all two lane highways be converted into toll roads.
if you want to goto from delhi to jaipur you have to go through 3 toll roads.(paying almost rs200)
has anyone filed a case or pil that interstate toll road highways violate article 19d?
 
from what i remember the regulation was to provide an alternate free route for every road that is converted into a toll road.

as my dad says... toll taxes are government sponsored extortion.

the frustrating thing is that the alternative route we gurgaon folks have to travel to delhi is through kapasheda.

roads are broken, one section is super congested due to shops. another area is congested because of an auto stand. this road is supposed to be a connection between gurgaon and delhi. but it feels more like a road going through a village.

of course, no one is bothered to repair it. no one is bothered to make it good enough for travelers. probably DSC Limited is involved in it. they have everything to lose if this road becomes useful enough for daily travelers coz they would skip the expressway altogether.
 
and 13 toobut my question is that do you think it is illegal,unconstitutional?
 
does it even matter what we think about it? government uses the excuse that the roads are managed by private builders so they need the money for maintenance. the same government run advertisements in papers asking us to pay taxes on time because it enables them to ensure proper development of infrastructure. if public highways are not part of overall infrastructure, then i have no idea what is. i mean the government has failed to provide a lot of basic amenities. safe drinking water (we all have to buy RO systems). stable power (we all have to buy inverters). poverty is not going anywhere. illiteracy is also not going anywhere. forget about sarkari hospitals unless you are a VIP getting treated at AIIMS. Toll taxes is a shame indeed.
 
charging toll tax is ok.. but i think they shud unify everything.say pay 5000Rs per year and u get a PASS, and u can move ur car around on any highway in India without paying.if u dont have pass then pay regular toll tax. simple.

why ok?.it violates free movement?.next you will say same gotra marriage is not ok even though it violates free expression
 
well i think we already deserve to get that pass through paying our taxes. we have a lot of freaking taxes... let me count some of them... income taxsales taxexciseservice taxgift taxfringe benefit taxvalue added tax ye tax, vo tax,there is also a tax named as local area development tax (LADT). all of these taxes are supposed to be used for something. infrastructure mostly. as for getting a single pass for all the roads in india? forget it. every damn toll road project is a corrupt mess. delhi gurgaon expressway for example. NHAI is to be blamed. DSC Limited i believe has the right to charge the tax for 20 years. the 20 year period was based on their estimates on the traffic on the road. and if i am to believe reports in newspapers the traffic estimates they made for 2020 are being crushed by traffic today. in simple terms. they are making more money than they claimed they would make in 2010. but since NHAI approved their figures, they would get the right to charge the tax for 20 freaking years. they would probably recover all the money they spent and are spending and would spend within a couple of years. after that it is pure profit. no one is going to hold them accountable for it. NHAI is deeply involved in the mess. a while ago, NHAI officials were raided. and a whole lot of money was discovered in their houses. :D

NHAI is responsible for developing the highways in the country.

Now, they are simply awarding contracts to private builders.

They get bribes. They get part of the toll charges. I think they are in a very good situation right now.

if anything happens, they get to blame the party responsible for the highway. they charge penalties, fines and yada yada.

i think anyone who is working in the management of NHAI is in a very good position to live his life rather nicely.
