Government can check easily by simply noting that same IMEI is being used by two active mobile numbers.
But point is how do we, the purchasers of the phone, know if IMEI was already used by someone else when we buy it?

what about imei codes of the millions of phones that are not inside india? assuming these devices are made in china, they can easily clone the numbers of series in china? 
but then they would still have to keep them unique for the units shipped to india. in any case, how can you ban the actual import 
when the phones are not being used even.
