yeap. and i am not in anyway going to defend the indian government here even though i as a tax payer am going to gain (lol) from the new rules. what is wrong is wrong. it does not matter if the government or the courts rule that it is right.

In india we can file PIL in any metter which related to public interest. Is their any system in US? Can some one file case again such a generic patent?

from what i have read, companies can challenge patents in courts to get them nullified. a lot of patents are canceled as part of failed lawsuits which are not successful i guess. in any case, the way things are i guess we would eventually start seeing more patents being challenged in the court of law.

a lot of people are already seeking a major reform in the patent system in the usa.

Defend Innovation

The case just got closed.Samsung is going to have to pay 1.05 billion dollars for infringing 5 of the 6 patents Apple had mentioned in the law suit. But there will be no ban on selling of samsung products in US.The same case in Korea was filed and the jury banned sales of both apple and samsung in Korea LOL.

While I can imagine the strategic impact of this Apple win, I still fail to understand why fanbois are celebrating this like Dussehra and Diwali (victory of good over evil)? One thief lost to another in the court of law. Simple as that. Where did values come into all this? It certainly is going to be bad for the consumers. Fewer phones in the US market, apple jacks up prices more. There will be more similar looking (Call them iPhone 4, 5 or 365) phones with a bitten apple in people's hands with only cases and covers to tell them apart. Innovation wins!

Err l am guessing iSheep are celebrating coz fandroids are complaining... Btw iphone has always been the same price since the iphone 3G... So ur claim that apple will jack up prices seems utterly illogical...
