Youtube checks against a database for copyright violation even if the media is not uploaded on youtube or anywhere else. That database is maintained by a third part iirc.
Some copyright owners use Content ID, YouTube's automated content identification system, to easily identify and manage their copyright-protected content on YouTube.
content id is an enforced form of copyright from google's content partners. it does not mean that the video i shot on my phone is not a copyright of mine. any photo i take from my phone is my copyright. any original text i write is my copyright. even if the production house that owns that movie content didn't make it part of youtube's content id ecosystem doesn't mean youtube is not violating his copyright.
problem here is that we have an it law that provides protection to intermediary parties like youtube. and google is complying with the government's requirements from my understanding. mumbai police filing an fir against pichai and other google employees is the idiocy here.
