In fact, they can start a mocking ad campaign.....add 1 or 2 channels themselves & then start a campaign wherein they show that "XYZ" DTH co. makes tall promises but never fulfils it.....whereas that particular co doesnt make tall claims, but does its job - keeping subscribers happy! Dont understand why no 1 has picked up this golden opportunity! Looks like i should give an advice on these lines & make a quick buck! 
Which promise have they not kept? d2h never said that they will add these channels at a particular date. In fact in the ads they say that they will be added shortly. So no one can take any action against them. Those channels will be added one day or another by d2h, unlike other dth which I don't think they are going to.
The only complaint for me is that, if they were gonna take this much time to set up channel addition, they should've only posted the ad only a couple of weeks beforehand not like one month ago and get everybody so hopeful. That too after deciding which and how many channels are they going to add.

@ jaymin : For such kind of advt, Indian DTH is nt ready. Its a very pre-mature industry as of now. Whereas if you see US DTH market, dish network and direcTv fights like Surf Excel & Tide in India

With compulsory digitisation in Metros & then followed by smaller cities, the market will heat up. Cable guys will lose their edge of "Multiple connection for the cost of 1". No better time than now, if they want to start getting at each others' necks!

The scene is similar to the scene that was in 2010 end, till Feb 2011. Every other day we had some or the other speculative date/conspiracy theory behind the launch of HD DVR. And that was since Aug/Sep 2010. And they finally launched it in Feb 2011! Thats around 6-7 months of wait. Expect a same sort of wait for these channels too! May be Airtel might have already reached 25+ in the HD channel count by then!
There was some news about TRAI setting some new rules and guidelines regarding the prices of channels within a pack for cable and DTH operators due to the recent digitization in the four metros . We could only think that they were waiting for the new guidelines to appear before they set the price and packages of the channels that they promised to add and then add the channels after that.

Then if there is no problem in transmitting the existing channels, then what technical difficulties are they having just for adding new channels? May be they haven't finalized the deals with the respective channel owners yet.

If they haven't finalised the deal, they would have never dared to published the advt. I think it is a game plan of d2h to encash digitalization. I even doubt now whether they have completed testing and operating on ST2 now.
