This may come as a shocker to you, but ACT computes FUP based on the total of uploads and downloads.
http://download.cnet.com/NetWorx/3000-2085_4-10155904.html
I have already sent them data and proved it to them for the past couple of months. In one instance, I had a total upload + download of 113GB, 23 GB being just uploads. Their usage site showed 114GB ! So my cap was reached when I had only 90GB of downloads for the month. I had upgraded the plan and my total FUP was 50+60GB = 110GB for the month.
I have complained to them repeatedly through all channels possible, but they have kept the issue lingering. No reponse from anybody. I had specifically asked for senior management details, and they never gave me any of those details, despite repeated complaints and requests.
They have been cheating their customers by incorrectly promising a contract they signed up for. This is broad daylight robbery.
I will request all users to install the said software, and monitor your usage regularly. If possible ditch them and switch to someone who has more ethical practices ...

Do they mention that uploads are completely free on their service?
Yes. From their website:
Code:
Fair Usage Policy (FUP) applies only on downloads. Uploads are not counted in FUP
