what's wrong with 2.3.6 for a couple of weeks more? wait for nexus 7 to become more widely available than going for a compromise product?

if you go for a non-nexus phone, you would find yourself stuck with 4.x when 5.x would be out.

Yeah, I know that on a non nexus phone I would stuck with 4. Some areas of my phones screen has not been responding for some time. I think it happened because of water. So I want to get rid of it!

duty is unavoidable if the phone being couriered but its only ~2.5% - 3% for mobile phone

Better use forwarding services like Borderlinx. I've read many guys have got their phones using Borderlinx and their cost includes customs, they get it cleared too.
