perhaps you can continue to post views about poor service from any provider if you are careful on the language used... like usually news agencies use the word "allegedly" when making statements.also if a forum member or other blogger complains about some providers service and you in turn want to blog about it, you could clearly say "a so and so blogger/poster complains about this experience"...no way in hell can lawyers claim you are harming their clients by clearly posting that these are not your own allegations or using words like "allegedly" etc, or clearly mentionign its a thirdparty blogger simply speaking about his own experience which nobody should be able to suppress.if the situation in india is that lawyers can harass you simply by bullying/threats with no basis in correctness/rightfulness then maybe its worth fighting back and counter-suing for damages, but really up to each person how much they want to get involved and fight on principle...

alright. finally decided to do the best that came to my mind. i think its a good solution. should satisfy all the parties involved.

Dear Sushubh,

We want you to delete the complete blog, it does not matter whether the comments posted in the said blog is positive or negative spirit. What matters to us is the negative comments without any evidences or proofs.

Further, if the anybody has a bad experience with Indiamart, they are free to dicuss those issues with the Complaint Department of Indiamart, which in the normal business practice the clients follows.

I fail to understand, what's the point in writing the problems in such type of blogs, its not going to help anybody in any way.

Furthermore, if you friends has bad experiences with Indiamart, kindly ask them to discuss their issues with the Complaint Department of Indiamart.

We are damn sure that these negative comments has been posted by the competitors of my client with the deliberate intention to harm the business and services of my client

In the interest of justice, kindly remove, block or disable the complete blog, from any & all the possible usages that imply or draw an inference that is negative to my client.

Furthermore, I would like to bring to your kind notice that if an Intermediary is put under a notice that some abusive material is either stored, passing through their servers and running with the help of the Intermediary, they have to take proper action for removing or disabling that material otherwise they could be said to have knowledge of the abusive material and held liable.

Waiting for your confirmation.

Thanking You,

Regards,

IndiaMart really is freaking annoying. I did more than what they had initially asked for. Now the lawyer says I should delete the blog itself!

Beware of Indiamart Web Promotion offers

----------

Just found out about this link...

WIPO Domain Name Dispute: Case No. D2007-0510

IndiaMart vs Essar domain squatting case! The same lawyer.

IndiaMart took over essarcellular.com domain name and connected it with a company named S.R. CellFun Zone.

I am seriously dealing with the scum of the web this time around.

----------

For all the foregoing reasons, in accordance with paragraphs 4(i) of the Policy and 15 of the Rules, the Panel orders that the domain name be transferred to the Complainant.

Here is our lawyer friend. http://en.netlog.com/danishalikhan

again... its really about how much you want to get involved. do you want to avoid the hassle and comply (a reaction which the lawyer might be banking on) or stick to your guns. im not saying you need to necessarily take this to court. at least consult some proper lawyer friends you know of (did you mention you already did?) to just gauge/measure what is the validity of their claims, then depending on that you could either drop it or actually contest.

i think i am going to take them on this time around depending upon how much it is going to cost me. would check with vaibhav again if he is interested in representing me. otherwise i would just contact raheja who i believe likes to get involved in cases like these.

He is alleging potential libel here.

Where do you draw the line tho ?

Between saying you had a bad time with said company vs trying to trash them for commercial reasons.

this reminds me of the team-bhp issue where skoda rep (not sure if it was a proper lawyer) tried to threaten the forum and members, but they are handling it differently it seems...of course they might have more clout and less fear for big corporate bullies :)
