well they are not enforcing it yet. but they should. digg was criticized heavily for enforcing their trademark and they defended it in a blog post. let me search that post
Apparently if you don't enforce the TM (meaning not let other sites use it), we run the chance of losing it... which would suck. The last thing we want is to lose our name.
