As per TRAI guidelines MTNL has to deliver atleast 80% of the said download speed. So in your case you are getting exactly 80% of 384kbps.Its sad that you can't lodge a complaint regarding this thing. Its kinda surprising that if MTNL is capable of providing more than 80% of 2mbps for other plans why can't it provide 100% of the said download speed of lower speed plans.

We should be careful when mentioning what speed you are getting.

Your max. bandwidth is 384kbps (kilo bits per second).
The speed you are getting is 48kBps --> this actually means 48*8 = 384kbps (this is because capital 'B" denotes 'Bytes' and not 'Bits').

1) So, what speed are you actually getting? Can you please clarify?
2) Also mention from where you are downloading.

There's nothing wrong with your connection or MTNL's service. You should factor in 8-15% of capacity as used up in network overhead. And ADSL may have some packet loss depending on line noise..etc. So a sustained speed of 38-40 kB/s is expected.
