Patent infringement battle between Samsung and Apple

in simple terms Apple did not 'invent' multitouch. they were just the first company to use it on a mainstream user device. and they got some patents based on it. patenting something and inventing something are two totally different things. the number of stupid patents given by the US body is hilarious.
 
just proving that you are trolling here. the i in your user id was just the first indication.when you claim that others copied stuff from you, you are pretty much claiming that you invented that particular thing. patent infringement is just a technical terminology of saying we invented this thing and you are stealing it from us. how on earth Apple deserve the patent for stuff that they did not invent in the first place? just because some idiots at the US patent office approve it, that does not really justify anything.
 
microsoft and Apple have a long patent deal. it is not exclusive to some mobile patents. the two companies have collaborative since the times when apple was nearing bankruptcy and an investment from microsoft saved their ass. the deal means apple and microsoft do not target each other over patent issues. and microsoft and Nokia have a broad patent license deal. and nokia as you might know has a pretty long list of patents that are related to basic functioning of a phone. these are the reasons you do not see apple and nokia and microsoft targeting each other over lawsuits. and microsoft has enough patents through the deal and on their own which has already seen almost all companies out there except for motorola mobility to sign a patent related deal. see a pattern here and you would notice that apple needs microsoft and their patents as much.

as for usa being a very smart and the patents awarded are all sane? that is just being ignorant. this is the same country which elected george bush two times. this is the same country which has literally gone bankrupt fighting two bloody wars. this is the same country with tea party movement and politicians like todd akin.

As for the point about innovations, apple is setting a very bad example for the mobile industry. Forget mobile industry, the complete tech industry. You should not be able to patent stuff like rectangular devices with full screen display or a wedge shaped laptop design. This is just bad. If every company had started thinking like that, we would be living in a very different world. Look at the big picture and you would see why these lawsuits are bad for everyone including you and me. But nope...
 
Ok lets look at this discussion point by point:-
1) It is pretty clear with the S3 & the Note 10.1 Samsung is trying to avoid using any of iPhone/iPad's design traits... Why they had to make them so ugly looking is anyone's guess... Other Smartphone makers have been making beautiful smartphones for years (HTC etc) without making them look exactly like the iPhone so y cant Samsung... & Its not like they are lacking in the design department either... They make some of the most beautiful LED TVs in the market today...

2) About jury contamination... Well it could be possible that some of the jury might have liked Apple as a company but saying all of them were biased towards Apple is just plain wrong & illogical... Everyone of the jury has to agree with the verdict or there is no verdict to begin with... Also during jury selection one of the 1st question they are asked if weather they are in anyway affiliated or use the services or have been in contact in anyway with either the defendant or the accuser... The ones who have are immediately excused... In this case the judge even asked the jury members not to follow the Apple vs Samsung case related news so as to avoid a bias...

3) About Apple inventing multi touch or not... Well I for one believe they actually did invent it... The reason is simple... Is there any other company/person claiming they invented it??? & if they did invent it y did they not patent it & let Apple patent it??? Also if say by any chance Apple wrongfully patented it they y did they not file a lawsuit against apple demanding the issued patent be cancelled??? These are some pretty simple questions most Android fans tend to ignore... I am not saying the patent system is perfect but the law of the land said they u cant use anyone else's patents without their permission then u cant just simple ignore the law in the name of "INOVATION" ... Even in India we have the patent system protecting one company from another... Sometime back Bajaj won a patent ruling against TVS in regard to its dual sparkplug technology... But if we listen to Andoird Fans this is a waste of time & even if Bajaj developed & patented the Dual sparkplug every other company should be allowed to use it free of cost...

4) Also although MS & Apple have had a long standing patent sharing agreement, Nokia has already sued Apple for its patents and the case that was settled out of court... Infact it is rumored that Apple pays about $9/iPhone to nokia... If this is true than this is another reason if microsoft buys out Nokia at the current price than it will be a tremendous good buy... Nokia's patents are a cash cow & not really factored into todays valuation...

5) Also I would like to state if so many Apple haters are allowed to post so freely on this forum why should a Apple lover(or iSheep or iTard as u may call him) not be allowed to post... Granted what igyan has posted is pure fanboy speech with one a few valid points & a lot of horsesh*t but it is his right to have an opinion & unless he is abusing someone he should allowed to post freely on this forum just as much as Apple haters are allowed to...

Finally this lawsuit is not about Money as everyone knows... Its about a moral victory for either Apple or Samsung... Its just 2 heavyweights in the mobile arena flexing their muscle...
 
a few minutes on wikipedia tells me that there were products available in the market that used multi-touch technology long before Apple arrived on the scene. DiamondTouch - Wikipedia, the free encyclopedia is one example.

as for why they did not patent the technology? i have no freaking idea. not every technology used in products today was patented. and if it was, things would be pretty bad.

i mean if every single damn thing is patented, it would become incredibly expensive for a new company to enter the market and launch their own products. they would be paying royalties to 100 different companies for every single damn thing.

you want to make a phone? company a owns a patent to rectangular design. company b owns a patent to a touchscreen display on that design. company c owns a patent on having a gui on such a device. company d owns a patent on interacting on such a device. company e ows the technology that powers this such a device and so on.

this is what i am trying to say for all along. if everything starts getting patented, there is not going to be any innovation because it would become prohibitively expensive to do so. apple is just setting a bad example. now, everything new that any company thinks of is going to be patented just because you would not want apple to patent it and sue you for it at a later stage. do we really want that? i certainly don't. do i care if apple ios devices get a face unlock feature in the future? why not. but do i want google to have a patent on it? no. sadly apple already has a patent on it even though tons of products have offered it in the past and google android devices already offer it. am i jealous that apple ios 5 has a notification bar similar to android devices? nope. good for them. at least they get something where widgets can run. but i am bothered about apple claiming that they invented universal search and android devices have no right to offer it without paying a royalty. tons of example have already been discussed again and again.

do i like samsung devices? no. i hate how they mimic apple ios products even though android offers them such a love user interface by default. they just mess it up. am i sad that apple won against samsung? not really. samsung needed a kick in the arse for shamelessly copying apple designs. but claiming that any device having a rectangular body with icons for user interface is stealing something from apple? oh please.

3M is another company that has done something similar i believe. they have a patent on post-it notes. they are the only company in the world that can manufacture post-in notes. baffles me. at least they invented post-in notes. apple reminds me so much of thomas edison. we all know what happened to tesla.

Haha I feel We in India cant really make fun of the politicians USA citizens elected to office considering the ppl we elect to run our country... For every Todd Akin we have hundreds who are even worse here in India...

Also If u look at the timeline of event then it was Apple who got sued 1st by Nokia & now pays a ton of money to Nokia for using the patents... So lets be clear on the fact that Apple started suing other companies 1st is just how the average Android fan views the situation & not what is actually true...
 
cook saying that the patent lawsuit was all about value is such an hilarious thought. it is not about money really. it is about values. looks like Apple is one company that can put a price on values.good luck to the mobile users in the US market because they are so ****ed up now as a result of this lawsuit. thankfully, we here in india are not affected much by it. we would still get all the devices no matter what kind of patent infringement they are causing according to which judge or jury in whatever country.as for Nokia suing apple starting the whole fiasco. i guess it just shows who decides to take the legal route to target their challengers when innovation enough fails to do so.As for me targeting him as a fanboy, the thing is simple. A new user comes on the forum. Has an iName. Posts only in posts connected to Apple. Praises them blindly without applying logic. In my experience, they are nothing but trouble. Nothing to contribute to the community. It is better to not have them than to have them just to prove that this forum has a democratic nature and everyone is entitled to their opinion. Yes, I am biased. But I am not someone who would blindly defend Google in everything they do. I do have a problem when reason and logic is being ignored.
 
As I said before yes the Patent sytem of the US(or anyother country to be exact) is not perfect... But on a broader point Patents do protect companies interests (even smaller companies) & in a way(believe it or not) do progress innovation... Also weather a system is perfect or not does not decide its validity in the court of law... Take the Govt vs Vodafone tax case... What vodafone did was probably wrong & evasive but it was not against the law as clarified by the Supreme Court... But after losing the case what the Govt did was very more wrong... They just changed the law & predated the changes to 1960(who says we havent invented time travel yet :p ) thus making the Supreme Court's judgement moot... However morally wrong or unconstitutional this move might have been the fact is today in the Govt vs Vodafone case according to the law of the land the Govt is right & Vodafone is wrong...
