Thats OK.. But xiaomi makes just 2% operating profit from its phone sales and then Ericcsion will be like 50% Partner of xiaomi...

I think the patent only concerns with Mediatek SOC so its better if they ditch mediatek completely
I think you have to purchase source code from Mediatek to release it to public which is why so many mediatek devices dont have kernel sources . Mediatek dont give a shit about GPL licences .
We will see , pretty sure Xiaomi has their trump card with them

Windows 10 Launching This Summer in 190 Countries and 111 Languages

Through a new program with Xiaomi, one of the top smartphone distributors in the world, a select group of Xiaomi Mi 4 power users will be invited to help test Windows 10 and contribute to its future release later this year. These power users will have the opportunity to download the Windows 10 Technical Preview – installing it and providing their feedback to Microsoft.

Not sure if it also means MS will ask Xiaomi to launch Windows Phone... Will it be successful like Xiaomi's Android based phones?
