Sanjay Dutt's Parole get extended by 1 more month
Dutt, 53, convicted under the Arms Act for illegal possession of weapons, was supposed to return to Yerawada Jail on February 21 on the expiry of his monthlong parole.
The divisional commissioner's office here granted extension till March 21 to the actor, who is serving remainder of his five year sentence, after receiving a mandatory report from the Mumbai police.
The authorities said that as per the rules, this would be the last parole leave for Dutt this year. Dutt sought extension of his parole to be able to look after his ailing wife, who recently underwent a surgery in Mumbai.

“The Petitioner submits that the bias/arbitrary attitude of the State government towards Sanjay Dutt itself shows the misuse of discretionary powers granted to it. Mr. Dutt being an actor and influential person is using his position/power to get undue advantage. The government has been rejecting parole/ furlough applications of other convicts in genuine cases, thereby favouring Mr. Dutt and thus violating Article 14 of the Constitution of India, which guarantees right to equality to every citizen of this country,” states the PIL filed by Pune-based lawyer Tushar Pabale.The petition has claimed that according to the Maharashtra Prison Manual 1979, a convict cannot be granted furlough exceeding 21 days in a year. Also, the convict has to complete a year in prison before being sent out on parole. Mr. Pabale has alleged that both the conditions were breached.“Within four months of being sent to Yerwada prison last year, he applied for furlough for 15 days, after complaining of leg pain. Accordingly, he was released from the jail on October 2 last year. When he was out on parole, he sought another extension of 15 days, which was granted to him. In December again, he applied for a month-long parole on the grounds of ill health of his wife. Since then, he has been out on extensions,” Mr. Pabale told The Hindu.

Though actor Sanjay Dutt's case may not suggest it, for a prisoner, getting parole is usually a tedious process, requiring the family to do much running around, while an extension is even more difficult to come by.

A former jail superintendent, speaking on the condition of anonymity, said that all prisoners may not be treated equally when it comes to granting parole, and that 'influential prisoners' had it easier. "For a common prisoner, getting parole is a complicated process and requires his or her family member to devote a lot of time and energy. There are several levels of verification and the smallest errors can get derail the entire process. You also need to have a good lawyer."

He added, "In my experience, influential prisoners have managed to get parole more easily. At times, those more deserving of parole continue to languish in prisons."
Parole extensions, he said, are few and far between. "The number of persons who have applied for parole extensions but have not received them is huge."

Dutt has been out of jail since December 21, barely a month-and-half after he was allowed to go on furlough leave for a month for medical treatment. On January 21, he was granted parole for another month, which has now been extended till March. The state has received criticism from several quarters for his prolonged stay out of prison.
