Ohhhh.....its a big issue....n i cn understand how much mental stress u might b facing...... now to be very honest ,,,you all 3 guys r equally responsible for this... number 1 is the shop keeper ..... number 2 is yourself ... and then at last place maybe samsung..... ,but the biggest fraud looking here is the shop keeper ...so please don't hesitate to contact samsung dynamically ....i mean via phone calls, by e-mail,going to service centre and keep record of everything what they replied to u.....its really so strange how samsung could be so irresponsible on this issue...if they are confident about their product.. they must ask the shopkeeper where is the problem....if someone is harassing you with their product then samsung must take an action against them..... well try your best and good luck ........

You are certainly taken for a ride by this shop, may be he's hiding the fact that their guy handled the phone incorrectly.
Do they think they have charged you 40k for a non-working handset.
Do they think you were participating in a LUCKY DRAW, khul-ja-SIM-SIM where customer is his own luck whether the product works or not.
You should have not paid them, or taken the money at the same very moment.
OR
called the COPS and lodged a complaint that handset is being forcefully delivered to you in a NON-WORKING condition and money is forcefully taken to
put another guy's mistake on you.

its the shop-keepers responsibility to check the handset before the customer leaves the premises and I would have not paid a single rupee for such a handset.

I agree.Paying 40k and getting out of shop with a defective piece was not a smart move. It's not online shopping! Shopkeeper was the one who inserted the sim.If it was not working then you should have immediately asked for a fresh piece. Now you might do the same thing but this time with support.Try consumer court.I remember a few months back I got a note 2 and before the bill was made I got it tested. So,if the piece was defective the shopkeeper would have changed the handset right away. Are you sure that the seal was broken infront of you?

Clearly i think the shopkeeper is running tou through...threaten him for consumer court...
Secondly..how the device is supposed to be out of warranty??
You just bought it!!
If the phone is getting repaired..then make the shopkeeper pay for the charhes of repairing..which is a difficult case to handle though!!

Wow, I would never shell out 40k for a non functioning device. Threaten them with police complaint. This is not some sh1t company like MMX where your phone goes bad as soon as you buy it.I wouldn't even use this phone if repaired as I would want to get a brand new piece and not repaired one.

Guys problem is I have been buying new launches from the same dealer as he gives me better price than any dealer in Bangalore. As usual practice he had shown the sealed box to me and I checked it thoroughly right to left but it was genuinanlly sealed. More so before opening the box, they swipe the card and then only they open it. When the defect was detected, he said he has to claim DOA and give it me and cannot invoice the DOA replacement HANDSET TO OTHER CUSTOMER. Since I had trust in him I left the place warning him that I need new handset the other day at any cost and no reason to be given. Today I met him again and explained my anger again, he was scared and told " sir samsung now a days have touched sky & seems like they are not bothered about one customer" inspite of my follow up with ASM of Samsung Bangalore nothing has moved forward.I know dealer has played very safe but I could not scold him beyond a limit bec of relationship. Major culprit I feel is samsung who is not approving DOA

AVIRAL- can you check with your friend if he can help usMore so I have heard from many dealer that Nokia used to replace with new phone within 24-48 hrs of purchase when they were touching sky. Dealer used to feel happy doing business with them. That's the diff story that they made crapy devices with hanging symbian

See whatever the problem might be,its the dealer who has to face it.YOU the customer just needs to pay and get the product.Whatever happens in between should not bother you.If the product was DOA then the dealer should have issued you another handset and he should be doing the same right now.Just tell him again that either he returns yours 40k or provides a new handset ASAP

Yes I have told him same- repair is not the option I want, need new handset or need my money bak. But only thing he is eating away is time to resolve this. Also what I feel dealer sounds helpless in front of Samsung. Further bashing will lead nothing but will eat away more time as dealer would say" you will have to give me more time as Samsung is not agreeing and need follow up". Cops will be least bothered to enter into this mess as they would simply prove this out of their jurisdiction & show me the way to appellate authority.
